Illinois Preventing Sexual Violence in Higher Education Act

The Illinois Preventing Sexual Violence in Higher Education Act (IPSVHEA) requires all Illinois colleges and universities to:

  • develop a clear, comprehensive campus sexual violence policy, including detailed incident reporting options and university response guidelines;
  • notify student survivors about their rights, including their right to confidentiality, and the protections the university can provide to ensure the student’s health and safety, such as obtaining an order of protection, changing class schedules or campus housing, and the availability of medical and counseling services;
  • offer a confidential advisor to survivors to help them understand their options and rights, including the options to report the sexual assault and to seek medical and legal assistance;
  • adopt a fair and balanced process for adjudicating allegations of sexual violence;
  • train students and campus employees to prevent sexual violence and improve awareness and responsiveness to allegations of sexual violence;
  • allow students to report information electronically, confidentially or anonymously (in addition to other methods offered by the college or university);
  • allow a third party or bystander to report an incident; and
  • respond to a report submitted electronically with key resources and information within 12 hours.

Annual Compliance Reports

Beginning in 2017, IPSVHEA requires all Illinois colleges and universities to submit an annual report to the Office of the Illinois Attorney General and Illinois Department of Human Rights demonstrating compliance with the requirements of the law. Loyola's annual reports include policies and procedures applicable at the the time (such as Loyola's Comprehensive Policy) as well as required data and information concerning trainings, prevention programs, reported incidents within Loyola's Clery Act geography, and the outcomes/resolution of formal complaints. Note that each report covers the calendar year within the report title, and is submitted by November 1st of the following year.

Annual SPEAK UP Survey Summary Reports

Beginning in 2024, IPSVHEA requires all Illinois colleges and universities to administer an annual climate survey to assess the campus climate with respect to sexual misconduct. At Loyola, we call this survey the "SPEAK UP" survey. Survey results must be submitted to the Illinois Board of Higher Education and published to the institution's website.
